1.        Plaintiff LEONARDO CARIAGA, is of legal age, married, Filipino citizen and a resident of Brgy. 12, Pasuquin, Ilocos Norte, where he may be served with court processes;

A copy of OCT No. P-71734, OCT Mo. C-5965, OCT No. C-5064, OCT No. 5066, OCT No. 72118, OCT No. 72542 and OCT No. P-71240 are hereto attached and marked as Annexes “A”, “B”, “C”, “D”, “E”, “F”, and “G” and made an integral part hereof.
4.      The original declared owner of the above-described real properties is Clara Cariaga. Copies of the Tax Declaration Nos. 3771 and 8813 are hereto attached and made an integral part hereof as Annex “H” and “H-1”;
5.      That Clara Cariaga is already deceased, the latter died sometime August 16, 1973 at Pasuquin, Ilocos Norte. A copy of her death certificate is hereto attached and made an integral part hereof as Annex “I”;
6.      That Clara Cariaga died single without any children and that she is also the daughter of the late spouses Evaristo Cariaga and Laura Cariaga;
7.      That Clara Cariaga has a sibling in the person of Evaristo Cariaga, Jr. who died sometime on September 16, 1938 at Pasuquin, Ilocos Norte. A copy of his death certificate is hereto attached and made an integral part hereof as Annex “J”;
8.      That Evaristo Cariga, Jr., sister of Clara Cariga. Was married to Andrea De Luna and that they were blessed with three children in the persons of Andres Cariaga, Feliciano Cariaga and Valenciana Cariaga;
9.      That Andres Cariaga was married to Cipriana Garcia while Feliciano Cariaga and Valentina Cariaga were both single and have no children;
10.   Spouses Andres Cariaga and Cipriana Garcia were blessed with the following children Manuel Cariaga, Rosita Cariaga Tabay and Leonardo Cariaga;
11.     That Manuel Cariaga and Rosita Cariaga Tabay have executed a waiver in favor to Leonardo Cariaga relinquishing all their rights in relation to these properties. A copy of the Waiver is hereto attached and made an integral part hereof as Annex “K”;
12.    That the original declared owner of said properties was Clara Cariaga as evidenced of the Tax Declaration as hereto attached as Annex “___”. However, after sometime said tax declarations were cancelled and transferred to Maria Ibalio. Copies of the Tax Declarations are hereto attached and made an integral part hereof as Annex “___”;
13.    That the act of Maria Ibalio in transferring said properties into her name was attended with fraud as no documents of conveyance were made by Clara Cariaga. Moreover, no records could be seen on how the same was transferred at the Municipal Assessor’s Office of Pasuquin, Ilocos Norte;
14.   Subsequently, it appeared based on record that Maria Ibalio entered into an Agreement of Voluntary Land Transfer dated July 22, 1993 before the DAR with herein defendants, who appeared to be all her children.
15.    Out of the execution of said Agreement of Voluntary Land, a new title was issued into the names of herein defendants. Copies of the said documents are hereto attached and made an integral part hereof as Annexes “______”;
16.   Surprisingly, the execution of said Agreement of Voluntary Land Transfer dated July 22, 1993 is of suspicious considering that Maria l. Ibalio has been long time dead, the latter died sometime March 27, 1983. A copy of the death certificate of Maria L. Ibalio issued by NSO is hereto attached and made integral part hereof as Annex “___”;
17.    That it could be gleaned that the transferring of the property into the names of the defendants were attended with great fraud as it is impossible for a dead person to rise and affixed her signature on the said document;
18.   Under the law, a forged document will not vest ownership in favor to the forger and that the real owners could recover the same from the person who unlawfully took the same.
19.   Previously, Leonardo Cariaga used to cultivate the abovementioned agricultural properties for their family inasmuch that he is an heir of Clara Cariaga, but upon the demise of his uncle in the person of Feliciano Cariaga, he was stopped by the defendant from further cultivating said properties;
20.  To avoid a repetition of similar acts and as a correction for public good, the defendants should be liable to pay the plaintiffs for exemplary damages in the amount of 100,000.00.
21.    That the certificate of titles in the names of the defendants and tax declarations in the names of the defendants must be cancelled and revert the same to the lawful heirs of Clara Cariaga who is the plaintiff Leonardo Cariaga;
22.  Due to the filing of this suit, the plaintiff suffered sleepless nights, wounded feelings and hence, they should be awarded moral damages in the amount left to the discretion of the Honorable Court but not less than P200,000.00.
23.   For the intransigence and defiance of the defendant, plaintiff was forced to litigate and hire the services of counsel for the consideration of Fifty Thousand (P50,000.00) Pesos plus Three Thousand (P 3,000.00) pesos per appearance in Court;

WHEREFORE, premises considered, plaintiff respectfully pray for this Honorable Court that after due notice and hearing, judgment be rendered ordering the following:
1.        Declaring the plaintiff as the true and lawful owner of the properties subject of the suit;
2.      To declare OCT No. P-71734, OCT No. C-5065, OCT No. C-5064, OCT No. 5066, OCT No. 72118, OCT No. P-72542 and OCT No. P-71240 registered in the name of herein defendants to be null and void ab initio and order the defendants to reconvey title over the said property in favor of the plaintiff;
3.       Ordering the defendants pay Moral damages in the amount of 100,000.00 Philippine currency;
4.      Ordering defendants to pay the Attorney’s Fees amounting to 50,000.00 and the amount of P3,000.00 per court appearance plus cost of the suit;
5.      Ordering them to pay the plaintiff the amount of 200,000.00 Philippine currency as exemplary damages;

Other reliefs, just and equitable are likewise prayed for.

            This is a verified petition filed by the petitioner, through counsel, praying for the correction of the erroneous entry with respect to his middle name.
            It is alleged in the petition that petitioner is of legal age, married, Filipino, a native of Solsona, Ilocos Norte and a resident of #4 Quezon St., San Andres, San Mateo, Isabela; that petitioner’s birth was duly reported with the Local Civil Registry of Solsona, Ilocos Norte and his Certificate of Live Birth states his full name as Rodrigo B. Benito and his parents as Avelino Benito and Alejandria P. Benito; unfortunately, his middle name was erroneously entered as “B” instead of “P” or “Pe”, the maiden name of his mother Alejandria Pe and his date of birth as March 14, 1956; that as such, a petition for the correction of his Certificate of Live Birth was filed whereby a decision was rendered correcting his middle name from “B” to “P” for “Pe” and his date of birth from “March 14, 1956” to “July 20, 1657”; that initially, the first petition prayed for the correction of his middle name directly/immediately from “B” to “L” for “Llanilio” but was advised for the reason that this cannot be done for lack of any justification aside from convenience, continuity and to perpetually avoid any confusions; that, however, petitioner is constraint to move for the correction of his middle name from “P” to “Pe” to “L” or “Llanilio”, the middle name he has been using since he started schooling; that petitioner has lived and stayed with his paternal grandparents until he was already of age to be enrolled so that his grandmother Saturnina Llanilio Benito was the one who enrolled him, filled up the enrollment form and the one who supplied his name as Rodrigo Llanilio Benito, hence, petitioner is of the belief that his true and correct name is Rodrigo Llanilio Benito; that the correction being sought does not pose any dangers or inconveniences and is not also intended to impugn his maternity or eliminate any linkages/relationships with his mother for when he got married, he explicitly stated his mother’s name on his Marriage Contract which shows he acknowledges his maternity; further, the correction being sought is not also intended to create confusion on matters of succession involving the estate of his late grandmother Saturnina Llanilio Benito as the estate has been divided amongst her lawful heirs; that considering it will not prejusice the petitioner since he has been using the middle name “Llanilio” in all his school documents, government records and the records of his children and in order to lessen the burden on his part economically, physically and emotionally, this petition is instituted.
            Finding the petition to be sufficient in form and substance, this Court sets the same for hearing on July 9, 2015 at 9:00 o’clock in the morning, in the sala of Branch 15 of this Court, Second Floor, Marcos Hall of Justice, Laoag City, at which date, time and place, any interested person may appear and show cause why the petition should not be granted.
            Let copies of this petition and this Order be served upon the Local Civil Registrar of Solsona, Ilocos Norte, the Civil Registrar General. Philippine Statistics Authority, Manila, and the Office of the Provincial Prosecutor.
            Let this Order be published at the expense of the petitioner once a week for three (3) consecutive weeks in a newspaper of general circulation in the Province of Ilocos Norte and in the City of Laoag.

PIDS expert says income tax cuts justified; warns gov’t of revenue loss

Proposals to amend the personal income tax schedule appear to be well-justified. However, these proposals should include measures that will allow government to recover the revenue loss from lower income taxes. Dr. Rosario Manasan, senior research fellow of state think-tank Philippine Institute for Development Studies (PIDS), said at a seminar sponsored by the Philippine Senate, that government should look for new revenue measures to compensate for the projected revenue loss that will arise as a result of the implementation of any of the various proposals to restructure the personal income tax. Currently, there are several income tax reform proposals pending in both houses of Congress. All of them, according to Dr. Manasan, have the same objective of addressing the phenomenon of bracket creep, which results from “non-indexation to inflation of personal income tax brackets”.
